FAFSA and divorce

Postby ROK761 » Wed Dec 30, 2009 10:39 am

I am a divorced parent of 2 children. I have a senior at a DIII school who is claimed on my ex's taxes while I co-signed on his student loans. His mother filed all FAFSA info when we went thru this process 4 yrs ago. Now his brother, who I claim yet she is the custodial parent to him, is about to place his FAFSA. Should I continue to claim the younger son on my taxes or do I release him to her and let her claim him and have her enter the FAFSA? I also dont know how many more loans I will be allowed to sign for. Any help is appreciated?

Tax claims for dependency are independent of FAFSA dependency. If your child is living with the ex more than 50% of the time, they must be designated as the parent on the FAFSA regardless of tax claims.
