ParentPlus Loan and Bankruptcy

Postby Will » Tue Apr 10, 2012 2:30 pm

Hello,

My parents took out a ParentPlus student loan to help me go to college. I got into my second year and had to drop out.

After that my folks filed for Chapter 7 Bankrupt petition and included that student loan as far as I know.

Now just this past month my IRS tax refund was seized by some company claiming I now owe this student loan of some $7,000. How can I appeal or fight this and any further action they may want to take against me personally?

Firstly, since the loan was in the name of a parent, your wages should not be garnished. To resolve a dispute like this, you can start by contacting the federal student aid Ombudsman's office. This office should help resolve any issues or disputes regarding your student loans. You can also submit a complaint at the Consumer Financial Protection Bureau here: https://help.consumerfinance.gov/app/studentloan/ask

Hopefully the Ombudman's office will be able to resolve this for you, or at least provide you with the correct contacts.
